Terms & Conditions - Geko Products Wholesale

www.gekoproducts.co.uk is a website operated by Geko Products Limited (we, our, us). We are registered in England and Wales under company number 08967534. Our registered office is at Hall Farm, Kirton Road, Egmanton, Newark, Nottinghamshire, NG22 0HG. Our Value Added Tax (VAT) registration number is 183662878
1. Contract Terms These Terms & Conditions of Sale apply to all goods and services supplied by Geko Products Ltd. Any orders placed are an offer to buy and no contract is in place until we have accepted your order. Automated emails are a notification of receipt not a confirmation of acceptance. The contract is subject to your right of cancellation (see section 5 below).
2. Description and Price of Goods We have taken every care to describe and show all items as accurately as possible. Despite this, slight variations in items may occur. We make every effort to display as accurately as possible the colours of the products that appear on our site. However, as the actual colours you see in the product images will depend on your monitor, we cannot guarantee that your monitors display of any colour will accurately reflect the colour of the product on delivery. All product images are used with the permission of the originator and remain the copyright of the originator. This does not affect your statutory rights. Please note, under no circumstances can back orders for dropshipped items be accepted. We use new and recycled packaging for sending our orders. The price of an item includes standard delivery and next day delivery is £5 + vat. This is a standard delivery per order to UK mainland addresses only excluding Highlands and Islands locations which are subject to a surcharge. Multiple items can be combined for a single customer in one order providing these are going to the same address. We provide you with product information on the website. If there is anything, which you do not understand, or if you wish to obtain further information, please contact the Customer Service Team by using the Contact Us page of the website.
Prices on the website are in Pound Sterling and do not include VAT, VAT is charged at the standard rate as laid out by the British Government http://www.hmrc.gov.uk/vat/. All products exported directly outside of Europe are not subject to VAT. This includes the Channel Islands, Bosnia, Norway & Switzerland. Both the product and extra shipping charges are zero rated for direct export outside of Europe.
Every effort is made to ensure the prices shown on the website are accurate at the time of placing an order. If an item has been under priced in error, we will contact you and offer the following three options:
1. Placement of a new order at the correct price of the goods;
2. Cancellation of the whole order;
3. Cancellation of your order for the mis-priced goods and reconfirmation of your order for the correctly priced goods.
If you do not choose one of the three available options within 14 days, your order will be cancelled. Any payment received from you with respect to the cancelled item(s) will be credited back to your original method of payment. We respectfully ask all customers to price our products around the RRP provided. This is to ensure the products are not devalued and all customers can fairy compete.
3. Payment Payment can be made by Credit/Debit card or bank transfer and shall be due before despatch of goods. If your payment fails your order will be cancelled within 14 days, unless you contact to specify otherwise. All transactions will be in pounds sterling. Non-UK credit card providers and banks will determine the exchange rates to be applied and may apply an additional processing charge in relation to such payments which non-UK card holders will be liable to pay.
No goods will be despatched until payment has been made in full, and the funds have cleared.
4. Delivery Standard delivery only includes most UK mainland addresses. Please see the delivery info page of our website for details of extra charges that may be applied depending upon the delivery postcode.
For dropshipped orders you will need to place a separate order for each customer you wish to send goods to. You can order multiple items to go to a single consumer and thus save on delivery costs. Delivery will be made to the address specified when you complete your order. Should you wish to change the delivery address after goods have been dispatched, we will require you to cover the delivery charges for the redirection. The charges will be the same as the original delivery charge. Orders will be delivered within 2-4 working days after despatch excluding bank holidays. However, Geko Products Ltd will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery.

If the delivery of the order is refused, or it fails due to you cancelling the contract, Geko Products Ltd will refund you within 30 days for any sum that has been paid by you with respect to the goods less the relevant delivery and return fee and our restocking fee of £10 + vat. By exercising your right to cancel, you are required to return the goods, at your own cost, to Geko Products Ltd. Our restocking fee of £10 + vat will be deducted from your refund.
All our deliveries are made by fully tracked courier services. Please ensure you provide a delivery address where someone will be available to receive the delivery between 7am and 7pm, Monday to Saturday. If the couriers are unable to complete a delivery due to nobody being present, a calling card will be left asking you or your customer to contact them directly to arrange a re-delivery. If you or your customer do not contact the couriers within 2 days of receiving this card, the goods will be returned to us and both a re-delivery charge and restocking charge will be applicable to your order.
Geko Products retains ownership of all items until they have been delivered to the recipient (either directly, or by leaving them in a safe place or with a neighbour). Once your goods have been delivered, the risk of damage or loss of the item passes to the recipient.
5. Refund Policy If you are eligible for a refund, we will refund you back to the method of payment you used when you originally paid for your order. Refunds can take up to 10 working days to process.
6. Faulty Item(s) If you receive goods that are faulty or incomplete on arrival, you must notify us within 24 hours of receipt of the item in writing by using the Contact Us page of the website. If the fault is verified, we will replace the item within 5 working days at no additional cost to you. We do not cover faults caused by accident, neglect, misuse or normal wear and tear. Courier delivery damage is also not covered unless the product is clearly signed for as "damaged" at the point of acceptance by your customer.
7. Item(s) Damaged on Arrival In the unlikely event of your customer receiving a damaged product, you should notify us in writing by using the Contact Us page of the website within 24 hours of receipt of the goods. If the damage is verified, we will replace the item within 5 working days at no additional cost to you. Please note that a condition of the couriers used to transport our items is that all goods be checked on delivery and signed for as damaged if any damage is present. Acceptance of goods without checking indicates acceptance in good condition. No claims will be entertained by our couriers where products are found to be damaged but no damage was noted at the point of delivery. It is important to ask your customers to check thoroughly on delivery and ensure that if the product is damaged in any way that they indicate as such when signing for the item.
8. Returns Procedure Products can be returned back to us at: Hall Farm, Kirton Road, Egmanton, Newark, Nottinghamshire, NG22 0HG. The restocking fee is £10 + VAT. The products must be in the original packaging and original condition or extra charges may apply. The return of any items is your responsibility. Returns are only accepted if they are received within 30 days of the original delivery. Before returning any items, you must inform Geko Products Ltd of the reason for the return and obtain an RMA number.
9. Limitation of Liability Geko Products will not be liable to you for any loss or damage in circumstances where:
1. There is no breach of a legal duty owed to you by Geko Products Ltd or by its employees or agents; 2. Such loss or damage is not a reasonably foreseeable result of any such breach; 3. Any increase in loss or damage resulting from breach by you of any item of this contract.
10. Placing an Order By placing an order with Geko Products you are confirming you have read and agree to the terms, conditions and delivery times as laid out in writing on this site.
11. Risk and Title
The products will be at your risk from the time of delivery. Ownership of the products will only pass to you at the time of delivery or (if later) when we receive full payment of all sums due in respect of the products, including delivery charges.
12. Data Protection Geko Products Ltd will take all reasonable precautions to keep the details of your order and payment secure. However, unless Geko Products Ltd are negligent, we will not be liable for unauthorised access to information supplied by you. Payment card details are not stored by us but by our payment provider. Therefore none of your card details are stored on our website. Geko Products Ltd will not supply your details to any third party.
13. Governing Law and Jurisdiction These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
